Terms and Conditions – Binners NZ

Effective Date: 6 August 2025

  1. Our Service
    Binners provides a rubbish and recycling bin management service, which includes moving bins to
    the curb on scheduled council collection days and returning them to their original location after
    collection. Services are available to:
    - Private homeowners
    - Renters and tenants
    - Airbnb and short-stay property hosts
    - Elderly individuals or their families
    - Property managers and landlords
    Custom service schedules or additional support may be arranged depending on client needs. Our
    goal is to make bin day easy, consistent, and hassle-free for all types of households.
  2. Client Categories & Specific Responsibilities
    a. Private Homeowners
    You are responsible for providing accurate access instructions and ensuring bins are accessible for
    collection.
    b. Renters / Tenants
    - Renters are welcome to book our services directly.
    - You must ensure you have permission (if necessary) to provide access to shared spaces or
    driveways.
    - Access instructions must be clear, and any gates, security codes, or entry arrangements must be
    communicated at time of booking.
    c. Airbnb Hosts & Short-Stay Properties
    - Hosts must ensure accurate bin collection schedules are provided to Binners.
    - Property access instructions must be up to date and accessible to our staff (including any gate
    codes or keys).
    - We do not inspect the contents of bins and are not responsible for improper waste left by guests.
    d. Elderly Clients
    - Services may be arranged by a family member or caregiver.
    - We treat all elderly clients with care and respect, and may offer extra support at no additional
    charge where possible.
    - If you are arranging service on behalf of someone else, you agree to these terms on their behalf.
    e. Property Managers & Landlords
    - You are responsible for ensuring tenants and contractors do not block access to bins.
    - We will not enter tenanted premises without prior written permission or access arrangements.
    - Our liability is limited to our bin services only and does not extend to property management tasks.
  3.  Bookings & Payment
    - Bookings can be made through our website, or email.
    - Services are charged per trip or on a recurring basis if arranged.
    - All fees are in NZD and include GST unless otherwise stated.
    - Payment must be made in advance unless an account is approved.
    - Late payments may result in service suspension

  4. Cancellations & Refunds
    - Recurring services can be cancelled or paused with 48 hours’ notice.
    - If Binners cancels a service, a refund will be offered.
    - Refunds will be processed within 5 business days.

  5. Access Requirements
    Customers must ensure:
    - Bins are accessible at the agreed time
    - Gates are unlocked or access codes provided
    - Animals are secured
    - Driveways or pathways are unobstructed
    We reserve the right to charge for a missed service if we are unable to access the bins due to
    circumstances beyond our control.

  6. Weather, Holidays & Council Delays
    - Services may be delayed due to adverse weather, public holidays, or council collection changes.
    - We will notify you in advance where possible and reschedule accordingly.

  7. Limitation of Liability
    While we take all reasonable care, to the fullest extent permitted by New Zealand law, Binners is
    not liable for:
    - Loss, theft, or damage of bins
    - Missed bin collections by council contractors
    - Injury or property damage caused by defective bins
    - Issues arising from bins that are overfilled, hazardous, broken, or in poor condition
    - Access problems due to incorrect or incomplete instructions provided by the customer
    - Damage caused by weather, pests, other third parties, or council staff
    Binners’ liability is limited to the cost of the service provided. Under the Consumer Guarantees Act
    1993, you have the right to services delivered with reasonable care and skill. If we fail to meet these
    standards, you may be entitled to a remedy such as a refund or repeat service.

  8. Privacy
    We collect only the personal information required to deliver our services. Information is stored
    securely and used in compliance with the Privacy Act 2020. We never sell or share your personal
    data with third parties without your consent. See our Privacy Policy for full details.

  9. Changes to Terms
    We may update these Terms at any time. The most current version will be available on our website.
    Continued use of our services indicates acceptance of any updated Terms.

  10. Governing Law
    These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in
    accordance with New Zealand law and within New Zealand courts.
